ruled guilty.


i can't believe its been more than six years ago..



i remember watching our senators walk out as if it were just a year ago, when it was announced that "the no votes have it". my hair still stands on end when i remember it. i remember my siblings and i rushing to join the historic edsa dos revolution. fighting for what we believed was right, joining jim paredes and thousands others singing "huling huli", waiting for "justice to be served".

then, erap stepped down, and gloria stepped in.

and now, though not in full, the verdict has been read.

not guilty on the charge of perjury.
guilty on the charge of plunder.
sentenced to reclusion perpetua
.

abs-cbn news anchor ricky carandang said earlier that in some way, each president we've had has been accused of some form of corruption. but it is only now that a case has been seen through to a verdict.

i am pleased that this chapter is almost over.. but it makes you think, how about all the other cases? how about all the other names that came out in the hearings on jueteng, the jose velarde account, and misused government funds? do they all walk free? how about all the others accused of corruption, independent of the erap case?



former president estrada answered a reporter's question on what his message to the filipino people is.. "nakakalungkot kasi ang ating mga kapitbahay na bansa ay umaangat ng umaangat, tayo hindi pa din.."

his camp will file for a motion for reconsideration as they fight for their stand that he is innocent.

president gloria macapagal-arroyo, through spokesperson ignacio bunye, issued the following statement after the verdict was read.. "we have a country to run, an economy to grow and a peace to win. we hope that this sad episode in our history will not permanently distract us from these goals."



i did join edsa dos to oust erap.
but i was also one of those who were pro-impeachment for gloria.
i'm sure there are many others like me, and many others who disagree with me.
are we just being too picky with a leader to believe in?
will it ever be possible for us to have a clean and honest administration?
we are a great people and we deserve a great leader, don't we?

in what case is it right to let go and forgive?
in what case is it right to keep fighting for what is right?

(this is all very confusing.)

The problem with us filipinos is that we never get contented. Whoever would lead our country will also be facing alot of distractors, accusers, denouncers, etc. just like Erap and Gloria. We never get enough of it. We may have succeeded in ousting erap, and then now we are trying to impeach gloria, I bet the next president wannabe will face the same situation as well...we never ran out of angst to say and the people's disappointments of having a "hero" has created a rage that continues to burn our economy. Instead of making this county a more peaceful place to live in, we are driving investors [or we may call them economic heroes] away because of such scenarios. We are even giving our own fellowmen enough reasons to leave our country too. It's becoming a habit. It's like a cycle...paulit ulit nalang. And thats the sad part of it.

hi!.. kung si erap nasentensyahan, bakit nga ba yung iba hindi? you're right.. what happened to the other people and the cases involved?.. hanggang dun na lang ba yun?..kinalimutan na.. si gloria, hindi ba dapat din siyang dumaan sa impeachment trial dahil sa wire tapping. matalino lang ba talaga siya dahil sa illegality ng pagwawire tap o sadyang bobo (sorry for the word) si erap dahil hinayaan niyang mahuli siya sa mga illegal na ginawa niya? katotohana lang ang gusto ng tao at justice.
naniniwala ako na meron pa ring good leader dito sa bansa. masyadong mataas lang kasi ang expectation ng mga tao. gusto nila magic, instant.

obviously we all know that the verdict will be GUILTY for former president Estrada, it was an injustice for him, i believe that PRES ARROYO controlled the decision of the SANDIGANBAYAN......what if the people of the PHILIPPINES will sue her with the same case?

i agree with you (in more ways than one)
the guilty must be punished. Erap deserves it. and so must gloria. i too fought for erap's ouster. and i am fighting for gloria's ouster too.
both of them made the Filipinos' lives miserable. the only difference is that, arroyo made our lives even more miserable.

when we talk about fascism and human rights violations, ang administrasyong arroyo ang nangunguna. dinaig pa niya ang rehimen ni marcos at nang ibang presidente.

dapat lang din siyang pagbayarin sa mga kasalanan niya sa sambayanang Pilipino. i just hope, precedent na ang verdict kay erap.

bianca, manatili ka sanang inspirasyon ng mga kabataan sa pagpanig sa katotohanan at katarungan...

Hi Bianca! :D Sorry pero walang koneksyon yung sasabihin ko about what you recently posted. Gusto ko lang sabihin na sobrang bilib ako sayo! Bilib ako sayo kasi hindi ka katulad ng ibang "artista". Ibang iba ka sa kanila dahil humble ka pa rin kahit na successful ka sa career mo. Masaya ako kasi nagshashare ka ng malaking bahagi ng buhay mo sa mga bumibisita sa blog mo. Dito namin nalalaman na hindi ka lang artista na ang gusto lang ay fame and money… Tao ka din pala na normal din yung mga nararanasan, nararamdaman at may paki ka din pala kung anong nangyayari sa mundo. Sobrang nag-eenjoy talaga ako basahin yung blog mo kasi may sense talaga lahat ng sinasabi mo. I want you to know na kahit sa simpleng blog mo na ito, nagagawa mo na ang isa sa purpose na binigay sayo ni God which is to inspire people especially the youth! when erap said this,ang unang pumasok sa isip ko ay "eh sana,nung umupo ka..nagawa mong iangat ang bansa"

i am scared with what will happen next. parang for the nth time, napaka unstable na naman ng situation ng bansa natin. i hope that we can finally move on and that we wont forget all the lessons we have learned from this sad sad experience.

i feel bad for the estrada family though.

hi!bobo lang siguro talaga si erap dahil nahuli siya sa mga illegal na ginawa niya.kasi naman pag ganun dapat magaling ka magtago ng evidence.yun di ka matrace.hehe!kasi sa paniniwala ko lahat ng pulitiko ay kurakot.tsaka dapat yung mga nag-aacuse ng mga illegal na ginagawa ng kapwa nila pulitiko ay dapat di lang kung may eleksiyon nag-iingay para sumikat at maalala ng mga tao sa oras ng halalan...

nakakatawa nga minsan pinaalis natin c erap, ngayon iba n ang nakaupo, papaalisin n nman natin? I am pro-honest election, of course. I am no economist...but what gloria did to our country like the strong peso nowadays is already satisfying for me, it's a great thing para sa atin (not the OFW's). Hindi n tau kulelat masyado unlike the erap regime napakataas ng peso that time. But our problem in corruption is hopeless. Sinong pulitiko ang hindi nangungurakot?

banas kasi lahat naman nagco-corrupt. si ramos ang andame pang pinapatay di naman umabot sa ganyan. ngayon ididiin nila si erap. weirdo talaga ng pinas. kaya walang mangyare saten eh. sige, impeach niyo na lahat ng magiging president in the future, ng ma realize nilang wala namang maitutulong yun sa bansa. kahit na ayaw naten sa nakaupong leader, bakit hindi na lang siya respetuhin? makipgaplastikan na, at least kung lahat magiging mabuti sa kanya mahihiya siya gumawa ng katarataduhan dahil alam niyang marame siyang madidisappoint. haaay. nakakapgaod na din ang ganitong sistema.

Erap is really a corrupt official and it sad that it took 6 years di ba?.. When I arrived here in the states, I appreciate a lot of things here na sana meron tayo dyan sa Pilipinas. Dito ang bilis nila sa mga cases while sa Pilipinas dios ko 10 years talaga ang hustisya!!!! Hay but I always pray na umangat na nga talaga ang economy ng Pilipinas kasi talagang napag iiwananan na tayo.

kaya tayo nde umaasenso kase yang mga taga-oposisyon walang ginawa kundi pabagsakin ang ating bansa para lang makuha ang sarili nilang interest. Escudero and Lacson i am talking to you.

kunwari pang para sa masa at para sa bansa..pero sa totoo lang pansariling motibo.

kaya usad pagong ang asenso natin dahil sa mga taong tulad ni erap na makasarili at mga mamayan na mahilig magcomplain. whine whine whine! our country is trying to move on pero pilit nilang hinihila pababa at sasabihin nde tayo umaangat. bobo tlaaga.

wala ng pagasa na magkakaroon tayo ng honest na leader. ang need natin ngayon eh kahit nde honest na leader pero may nagagawa sa bansa, like FVR and Gloria. haha!

grateful nga ako at dinaya ni Gloria ung election (kung dinaya man nia) kase ano nalang tayo ngayon kung naging president natin si FPJ, tapos namatay pa..eh di sino na president natin? I think we should thank Gloria. :)

at alam nio ba na mga investors from abroad pinagtatawanan si erap kase he is a joke daw..at ipupull out nila ang business nila d2 kapag si FPJ ang nanalo, like ung sa call center na pinagwoworkan ng friend ko. you can just imagine kung gaano kadami ang unemployed kung si FPJ ang nanalo.

So tama na ang reklamo at kahahanap ng kamalian sa president natin.

Hi bianca! Reading from your blog, I can say that you are a wonderful person, a beauty inside and out.

I am happy with the conviction of Erap for plunder. But my question is, then what? Just hours after the verdict was read, politicians are asking for "Presidential Pardon" for him. IF, Gloria will grant Erap presidential pardon, don't you think "other old and ailing prisoners", who committed 1 crime on 1 person should also be pardoned? I have nothing against "forgiveness". But the person being forgiven should also face the consequences of his faulty action.

almost all politicians at some point committed plunder one way or another. i did join edsa dos too, i never liked erap and i am soooo thankful he was ousted and now convicted.

its just sad that some opposition and other lawmakers wont stop all the unnecessary hearings left and right instead of focusing on what they really have to do while other government officials tries so hard to move on... pilit parin nilang hinihila pababa.

unlike you though, i am pro-GMA. she works so hard... yes, she lied and probably also guilty of plunder in some way but heck, who isn't? she doesnt have word of honor, yes... but like all the other politicians who are against her, they dont have word of honor too.

i'm with the lesser evil, if she's gonna be impeached/ousted, who will replace her? every opposition speaker promotes himself and there is no hint that those various groups are united. they have no common order of business or economic agenda, or clear cut political stabilization agenda. it will just be chaos and more chaos.

i'd rather have the president who lied but works her ass off every single day... the president who has specific goals for the country and is achieving 'em slowly. our economy is slowly booming and unemployment is down etc. etc. i'd rather have a president who is not popular but have done good things for the country.

we all want solutions... solutions... we all want a better Philippines, but that doesnt happen overnight.

i have much to say about this topic so i better stop. :)

wow! it doesn't focus only for politics but for life in general. even i, i always asked myself that 2nd question. minsan kasi pasaway ako pag prinsipyo na ang pinag uusapan. i am always firm with my conviction, minsan nga sabi nila, ang tigas ng ulo ko. eh kasi nga yun ang alam kong tama. madalas kasi ang hirap i-compromise ng mga bagay-bagay sa buhay, pero kung tama ka naman at kung paninindigan mo yun, wala namang masama na ipaglaban. siguro naman diba? :) bow talaga ako sayo. you always surprise me with the posts you made. lalo na sa mga views mo on different issues. bow. :) hehe.. let's keep on fighting for what is right and i know it will just pay off if not here, then it is in God's eternal place. take care. It is okay to forgive but we should never forget. This is the problem with most of our voters, we tend to forget what had happened in the past which leaves us with the same old traditional politicians that we ousted from the previous administrations.

I'm just a kid when I saw and joined Ninoy's burial parade as it passed by our town... which of course I have no idea what's happening then till I saw edsa 1 in tv unfolding... I joined edsa 2 as part of yuppies who wants to make a difference or just trying to be one in the crowd or as a mere spectator. I totally ignored edsa 3 because I feel tired doing this thing which I personally think it doesn't make a difference anymore. After few presidents we had... nothing changed... false hopes and promises unfulfilled. Philippines remains at the bottom of the pit and trying to dig even deeper. Whoever we put in the government will surely be tempted in corruption unless you put a saint in the position. Everybody has his own personal agenda. The real problem is poverty which I think should be addressed properly not instantly otherwise it will be the same scenario afterwards. We must really learn not to repeat histoy!

Regarding your concerns for the "other fish", don't you worry. We will eventually get there.

What is important today, we were able to implement the rule of law even for a very powerful and influential public figure. It sets an example to the region that we have a sound judicial system.

You know in Japan, Taiwan, China, and Thailand, Political Leaders get sued all the time. And a lot of them get convicted and are really sent to jail. So much so that now, these leaders don't wait for a judgment--they voluntariy step down from office. Look at Japanese Prime Minister Abe. He stepped down from office amid numerous allegations.

Their judicial system there is so efficient and dependable that politicians don't wait for a conviction. They resign immediately.

So, I praise the conviction of President Estrada. I hope matapos na yung case (i.e. di na siya mag-appeal) and he serves out his sentence.

And as for the "other fish in the sea", well, we'll just have to wait for their day. Mahuhuli din natin yan.

Hinay hinay lang. We'll get there.

para skin, lahat nmn ng pulitiko dito satin corrupt..maging tau hndi natin namamalayan sa mga simpleng ginagawa natin s araw araw..mga kaugaliang pilipino n nauuwi din minsang masamang epekto..

kaya dapat simulan natin dapat sating mga sarili, pataas papunta s mga pulitiko n yan.. halimbawa n ung kay erap..kaunti nlng, bagong bansa n uli tau. :]

Wow...I was second high school when ERAP was ousted and now I've been living here in NY for 1 1/2 year already and it's only now that they decided to give him a GUILTY verdict. How sad that the supreme court took 6 years to decide for that. What took them so long to decide?. As for Erap, from the moment you step down in Malacanang, you've given yourself GUILTY to those accusations and good thing to step down early if not, it should have been more difficult to live in the Philippines. Masses may have been poorer if you're still the President. And as for GMA, I think you're doing a great job even though you had some big mistakes. I think that mistakes were a great move..As for Filipinos, please accept the that GMA is the president. Just support her in whatever thingd she's doing. For the activists out there, stop the rally, stop burning those faces whoever your fighting againts. You're discriminating them. For congressmen, senators, just for once, please stop bashing to one another. Propose a bill, study that bill, if that bill benefits the nation, then pass that bill...
Support to the President and to one another is all we need...

ang mentalidad kc ng mga pinoy, pag masyadong lenient ang gobyerno eion reklamo ng reklamo. wala namang magaling na presidente sa atin eh... lahat nakatikim ng banat na kala mo naman may pwedeng ipalit na mas matino...
tama si erap, ang mga kapit bansa natin ay talagang umuunlad tayo na lng ang naiiwan.
ang tanong ja: "may talangka ba na ngtagumpay?" eh pare-pareho lng naman tlga lahat. pano naman tayo uunlad eh, nasa sarili natin tayong bansa pero di naman natin ma-disiplina ang mga sarili natin? eh bakit kahit masyadong brutal and degrading ung treatment sa atin ng mga banyaga pag nasa nila tayo eh talo pa natin ang maamong tupa sa sobrang pagiging masunurin sa batas at napakalinis natin sa lahat ng ginagawa natin, para ba hindi tayo mapalayas at mapauwi ng pinas ng di oras?

thats the sad part of being a filipino. lahat nagmamagaling at naggagamitan, lahat may duda sa isa't-isa. all they have in mind is politics. its true, we cannot blame other citizens, families leaving our country... kahit ako guilty sa pagiging distant and sometimes to the point na walang pakialam sa mga nangyayari sa bansa natin all because i lost the love for this country because lahat nalang na maupo na leader masyadong pulitiko(or worst a TRAPO ONE). incidents just happen almost always the same from one president to the other, different style nga lang and its so nakakasawa..... di bale ng 2nd class citizens sa ibang bansa- you get to own 2 cars, a house and lot and even can afford na punuin talaga fridge mo all the time because their taxes are really working and servicing them. not to mention medical system.... haaayyyy kelan kaya tayo mauntog ng mauntog na malakas para naman umahon tayo sa kumonoy na kinalalagyan ng ating bansa...... is such a pity...

my pgc prof was one of the lawyers from the prosecution panel. ang sabi niya sa amin, the message of the verdict is that the justice system in the Philippines still works after all and that if it's possible to put a former president to jail for plunder then it's not impossible to put those corrupt officials in positions lower than him to jail as well. sana nga there's still hope for our country.:P

I think most of us knew or at least felt that he was going to be convicted. Not to take sides or anything, but there was probably nothing that Former President Erap could've done. Things were beyond his control.

I would like to appeal though to journalists and reporters, to please, verify your facts. I have watched several news programs and have also listened to AM stations. A lot of headlines say that Erap is convicted and he is supposed to have "Habambuhay na pagkakulong...."

As a matter of information and for everyone's guidance, Reclusion Perpetua is NOT life imprisonment. Reclusion Perpetua has a necessary consequence of 30 years minimum imprisonment, after which, the convict is eligible for pardon. In addition to this, the maximum time of imprisonment is 40 years.

I really hope that we'll have a clean & honest administration. Pero dahil hindi naman tayo perpekto, talagang mahirap isipin na ito'y mangyayari. What we need is a great leader.. but who? Pwede bang ikaw, Ate Bianca?! :D
I think the leader that all we need is God. When we're ruled by His kingdom, we do right things. Kahit na gaano pa kagulo ang mundo, may pag-asa pa rin dahil may Diyos na nagmamahal. When we experience His love, we can forgive. I think that it's really hard but it's the right thing to do.

I was Grade Four when I innocently joined the rally to impeach Erap from Presidency during the EDSA Dos. I really witnessed almost every event that took place.

I am already First Year College, and I finally heard the Verdict. However, I also realized: Was I really fighting for the right thing six years ago? Or was I making a fool of myself?

Ewan ko, but politics is getting to be a headache for us.

Yet I believe na nasa kabataan pa rin ang pag-asa. It's up to us to correct our mistakes.

hindi ko din alam anung sagot sa tanong mo. when is the right time to forgive and just move on and when is the right time to fight for justice and truth.

ang akin lang, being a president is an arduous job. let us all not make it even harder for them. we complain a lot but most of us don't do their share of responsibilites as a citizen of this country. reklamo ng reklamo pero pabigat naman sa lipunan. simpleng pagtawid sa tamang tawiran at pagtapon sa tamang lugar, hindi magawa.

i also joined the millions of people who ousted erap last edsa dos. though i am not a pro-gloria, neither i am an anti, too. and i still believe that this country can rise, that we can have a "righteous" government.

sabi sa bible, masama ang spirit of rebellion pero paano kung ang nagllead sa'yo ay ang the one who does evil, diba? i don't know. i really don't know. but i believe in God's word that He will not let the land of the righteous and its people suffer. we just have to turn back from our bad, evil ways.

ang the best lang siguro na masasabi ko, let us not just concentrate on finding the right/perfect leader for us. let us concentratte more in being a responsible and good citizen of this country.

We Filipinos are too CONTENT contento na tayo sa mga leaders natin, mayors, congressmen, govt officials, even if alam nating mali sila and they aare corrupt we just accept it as part of life and :our culture" please lets not add to that. ang baba na ng standards natin, ibababa mo pa. YES lets be less content! lets be vigilant! wag tayo papayag until we have leaders that we deserve! pero if feeling natin, okay na yang ganyan, if nakkukulitan tayo sa mga taong may prinsipyo, edi siguro nga totoo. we get what we deserve...

its always easier to find flaws than a greatness of a things.

kahit sinong umupo, hanggat may nakikitang mail, pupunahin, palalawigin at palalalain, in the end people hanging on the branches suffers.

i am happy with the decision regarding erap, only because at least now there would be no more of these issues, which only gives bigger rooms for other issues in the news.

part of it i guess, is talagang di tayo makuntento, no wonder why alot our fellowmen have taken the risk of going overseas and work. but i only wish that instead of being an escapist, let's all hold each other tighter and make our prayers the best weapon against the burden of this country.

im young and free, but im worried of my future.

you know why PGMA will not share the same verdict as Former Pres. Erap? it think its because in the back of our minds, we are a bit happy with what pgma has been doing... the economy has been up, the rate of the peso against the dollar is decreasing, more and more foreign investors are coming in the country... seeing all of these, we tend to think that "kahit paano may nangyayaring mabuti sa bansa..." it might not be the drastic change we are all longing for... but at least we're moving to the right direction... as an example, we all generalize that all mayors are corrupt... but what does a certain mayor have that makes him unbeatable in his city [where senior citizens can watch movies for free c",)]... many have tried to unseat this mayor, shoving the city's residents with the incumbents' supposed faults, crimes and corruption (we might be able to say that some if not most of them are true)... some of his constituents might have thought of unseating this mayor, but this mayor continues to reign in the ballots... why? its because even though we perceive him to be corrupt like most of them, at least he still gives back to that city... their city is one of the most productive... and cleanest i might add and the residents have so many benefits that makes people from other cities envious... unless you can give them a better option, they'll stick to the current one... and i think that's the case with our current administration... unless we are presented with a better option... (it doesn't even have to be the best...) then we don't mind sticking it out for the incumbent...

We are lead by humans. It is futile to even think that we can have the good kind of leadership in our country when our leaders are all human like us, so imperfect no matter how noble(?) their intentions in serving the people.
The only thing we can look forward to is for Jesus Christ to come back so that we may able to live the life we have been longing for, you know, all the joy and peace we can enjoy not only here in our country, but for the whole earth. And how is that possible? God said, "if my people who are called by my name, will HUMBLE themselves and PRAY, then i will hear from heaven and heal their land.."

what we saw in TV or in newspapers about politics, administrations are not the real world. this world of capitalism and communism is far from our imagination. democracy means equality but there's something beyond that and only people who have big powers in the world can utilize every single aspect of it. Philippines is not actually lead by our president GMA, we are being lead by other forces indirectly. the president has no control in everything, she's involved in so many societies and dealings internationally. i really believe that our country needs a great leader who shall lead us into path of greatness, who shall embody our ideals and aspiratios, who shall hold the country in his own hands, who shall direct international in his manipulation, and who shall make the world history.

kudos to everyone, may we enlighten our minds and see the the real action in the real world. this is a world.

hello bianca, this is sweet from muntinlupa. I just learned thru my sister that you have a blog site & she is your biggest fan & mine too. We love you because you'renot only beautiful but smart as well. I don't really watch local channels but when you were a part of PBB celeb ed, I made it a point to watch every single day... Anyway, my i agree with you about erap & GMA. My siblings & I were also one with a lot of filipino people @ edsa dos and at the time i was really praying that this time around with GMA everything would change. So I felt cheated & betrayed when the hello garci scandal happened. But despite of all the hoolabaloos that's been happening in our country right now, I am still not giving up. There is still something in me that believes in the Filipino people. All we got to do is to stand up for what e believe in & fight. Just what like Solita Monsod said during her interview @ Proudly Filipina & I quote, 'we should stand for we believe in & never compromise because the moment we compromise we are slowly putting down our principles until it all falls down & say Ah ok na lang. Sige na nga." She also said that we should not complain & blame everything to the national government. Its true because we are all responsible for the future of our country & the only way that we can prosper as a nation is when we all get together & do our part...

Politics is all very confusing, not just here but i guess in most parts of the world. I don't really know but there is a nagging feeling that even after the convictions of Erap and maybe, Gloria and all other corrupt officials, the only real losers remain to be the poor Filipinos left with nothing but a dream of a better life.

I think it is about time we ignore all these politicians and focus our energies towards something else. Other heroes perhaps. True Filipinos need not join politics to help fellow Filipinos. Let us stop looking for our nation's redemption from government leaders. Even regular individuals and not just the moneyed, can contribute. And if you do have the money, what better way to use it than to help others succeed, too.

Joseph Estrada’s biographical documentary “Ang Mabuhay para sa Masa” was rated X last year because the part about Edsa People Power II tended to “incite political rebellion,” but the nation was not indignant. The censors took umbrage at the closing line: “Nalalapit na ang bagong umaga dahil sa lakas ng puwersa ng masa at muli nang babangon.” [“A new day is dawning because of the power of the masses and they will rise again.”]

Now the Movie and Television Review and Classification Board (MTRCB), thus emboldened, has just tried to block a human rights film, because it is “unfair and one-sided and undermined the people’s faith and confidence” in our government, and we are aghast. We have been warned: “As thou hast sown, so shall thou reap.”

Just last week, the Filipino-Chinese community lamented the racist outburst by Sen. Miriam Defensor-Santiago on the Senate floor, yet, even as the senator apologized, some defended the Filipino’s ingrained anti-Chinese bigotry. Barely one week later, we are all up in arms over a scene from a US TV show, where a lead character, talking to a doctor, said: “Okay, before we go any further, can I check those diplomas? Because I would just like to make sure they’re not from some med school in the Philippines.” (If all the US-based Filipino doctors and nurses went on strike, won’t their health system go haywire? I wonder.)

I didn’t get to see the 13 independent short films depicting our human rights situation during its short run. Apparently, the MTRCB initially rated them “X.” (The gradations are, from mildest to wildest: G or GP -- General patronage; PG-13 -- Parental guidance for children under 13; R-13 or R-18 -- Strictly for persons over the specified age; and X -- Not for public viewing.) As of this writing, the MTRCB has mercifully revised its position and released the film for a wider R-13 audience.

Collectively entitled “Rights,” the film series apparently consists of clips as short as regular TV commercials, independently produced, and shows disappearances and scenes of torture. The killings are no fabrication. Government and UN fact-finders have all confirmed them, and they have warranted action, no less, from the Supreme Court.

The films, reports say, had none of the usual excuse for censorship, namely, obscenity. Remember “Kapit sa Patalim,” a socially relevant Lino Brocka film for which the censors were haled all the way to the Supreme Court during the twilight years of the Ferdinand Marcos era? The government tried to suppress it by citing nudity in the depiction of bar girls. A few years ago, in a bizarre move, the censors gave an R rating to “Schindler’s List” because, and this gets even sicker, it showed naked bodies inside the gas chambers!

Party-list Rep. Crispin Beltran hit the nail right on the head: “It’s not for the MTRCB to judge the film’s content on whether or not it undermines the public’s faith and confidence in the government. It will be up to the audience to decide that.”

Beltran has seized the heart of the doctrine allowing only the “content-neutral” regulation of speech. Government may not regulate speech on the basis of its message, but only on its overall effect that, in this case, would pose a “clear and present danger.” In other words, in our constitutional order, there can never be such a thing as a government-sanctioned truth -- a politically approved official version that we are all bound to accept. “The best test of truth is the power of the thought to get itself accepted in the competition of the market,” said Oliver Wendell Holmes Jr.

It is a rejection of what US Supreme Court Justice William Douglas called the “suffocating influence of orthodoxy and standardized thought.”

That is why when the MTRCB justifies its X rating by saying that “Rights” was “unfair and one-sided,” its decision was content-based, but it would scarcely give me any comfort if the MTRCB reverses itself by saying that it was fair and objective after all. Whether speech is biased or balanced is for the audience, not any government board, to decide.

The sole question before any government agency should be whether the danger posed by the speech is so imminent that it is “dangerous to leave the correction of evil counsels to time.” The classic formulation was made by Holmes: “The question in every case is whether the words used are used in such circumstances and are of such a nature as to create a clear and present danger that they will bring about the substantive evils that Congress has a right to prevent.” I understand that the MTRCB eventually found its way and applied the clear and present danger test.

The real worry is not about government behaving badly. It is about a passive people immobilized by political correctness and unwilling to advance “freedom for the thought that we hate.”

The other concern is that we have already sent a chilling effect on young and independent film-makers, who may now shy away from politically sensitive topics. Worse, it may have scared away film producers and potential investors.

The libertarian Douglas warned us to be alert to these slow encroachments on our liberties. “As nightfall does not come at once, neither does oppression. In both instances, there’s a twilight where everything remains seemingly unchanged, and it is in such twilight that we must be aware of change in the air, however slight, lest we become unwitting victims of the darkness.”

wala sa president ang ikakaunlad ng bansa...anong magagawa ng isang napakagaling na presindente kung mismong mamamayan niya ang may problema? hindi kaya ng iisang presidente na iangat ang bansa natin... we have to do something...we are aware of what's happening to our country..but are we doing something for it? so hindi natin pwedeng isisi lahat sa presidente natin lahat ng kamalasan ng bansa...for example..ang laging issue na "kotong" sa kapulisan...makakapangotong kaya sila kung may magbibigay ng kotong?? or sa mga traffic agents...yung mga nanghuhuli tapos mangongotong... bakit ka magbibigay ng pera para makalusot sa kasalanan mo?why not just give your license and follow the legal proceedings or better yet follow the road rules ng hindi ka mahuli?? gets my point?? minsan kasi satin na ang pagkakamali..ang kaso..pinapasa natin sa iba...as what the saying says... "nakikita natin ang dumi ng iba ngunit hindi ang sa atin"

Is it possible for us to have a clean and honest administration? I dont think so! But its not all about the administration nor the opposition, we cant blame them for everything thats happened! Blame the people as well... we never get contented with what we have. We always want to do the trial and error method and find out whats best for us. Well, life is always like this!
